“Owners and occupiers of non domestic premises, who have maintenance and repair responsibilities for those premises, have a duty to assess them for the presence of asbestos and the condition of that asbestos”

Where asbestos is present the duty holder must ensure the risk from the asbestos is assessed. A written plan identifying where asbestos is located is prepared and the measures to manage the risk from the asbestos are set out in the plan. Other parties have a legal duty to co-operate with the duty holder.


In 2010 the Health and Safety Executive publication MDHS 100 was superseded by the new and current publication HSG 264 ‘Asbestos: The survey guide’. The ‘survey guide’ describes the types of asbestos survey and when they are required to be carried out:


‘Management Surveys’ will be required in accordance with ‘Regulation 4’ of the Control of Asbestos Regulations 2012 (CAR 2012) for any duty holder of a non domestic property that was built or refurbished before 2000, or where there is a responsibility to maintain a domestic property such as through a contract or tenancy agreement. Management surveys are ‘non intrusive and are required for normal occupation and use of the building to ensure continued management of the ACMs that are in situ.

‘Reinspection Surveys’ Even after your management survey and any subsequent action plan is completed, you need to continue to manage the risks from asbestos left in place in your building. Our reinspection surveys will review the condition, update and record all ACMs left in place, including those you have sealed or enclosed, to see if they have deteriorated or been damaged or disturbed in any way. The time between inspections will depend on the type of material, where it is and its condition, but it should be at least every 6 to 12 months.

‘Refurbishment and Demolition Surveys’ will be necessary when the building (or part of it) is to be upgraded, refurbished or demolished. It is probable at larger premises a mixture or the survey types will be appropriate, e.g. a boiler house due for demolition will require a refurbishment/demolition survey, while offices at the same site would require a management survey.
